These Training Terms and Conditions (“Terms”) govern the provision of training courses by Digital Rugby (“Provider”), a brand operated by 1 Point 3 Creative Ltd, with an operational address at 24 Regent Place, Rugby, CV21 2PN, United Kingdom.
By accepting a Quotation or Client Order, the Participant agrees to these Terms. These Terms are applicable as of the date of the Quotation or Client Order.
1. Course Details
1.1 Course Information:
- Detailed descriptions of training courses, including topics, duration, format (in-person or online), and fees, are provided in the Quotation or Client Order.
1.2 Training Materials:
- Participants may receive materials such as slides, handouts, or digital resources, which are included in the course fee unless otherwise stated.
1.3 Schedule and Delivery:
- Courses are scheduled as per the dates and times listed in the Quotation or Client Order. Digital Rugby reserves the right to reschedule sessions with reasonable notice.
2. Enrollment and Payment
2.1 Enrollment Process:
- Enrollment is confirmed upon acceptance of the Quotation or Client Order and payment of the required course fees.
- Places are allocated on a first-come, first-served basis.
2.2 Payment Terms:
- Full payment is required at the time of enrollment unless otherwise agreed.
- Payments are non-refundable except as outlined in Section 6.
2.3 Late Enrollment:
- Participants enrolling after the course start date may be permitted to join at the discretion of Digital Rugby, subject to availability.
3. Participant Responsibilities
3.1 Participants are responsible for:
- Attending all scheduled sessions on time.
- Ensuring appropriate equipment and internet connectivity for online courses.
- Complying with the Provider’s code of conduct, as outlined in the course guidelines.
3.2 Participants must notify Digital Rugby promptly of any changes to their contact details or ability to attend the course.
4. Provider Responsibilities
4.1 Digital Rugby is responsible for:
- Delivering high-quality training as outlined in the course description.
- Providing timely communication about course schedules, materials, and changes.
- Maintaining the confidentiality of Participant information in compliance with applicable data protection laws.
4.2 In case of unforeseen circumstances, Digital Rugby reserves the right to substitute instructors or modify the course content while ensuring the objectives of the course are met.
5. Cancellations and Refunds
5.1 Provider Cancellation:
- If Digital Rugby cancels a course or session, Participants will be offered an alternative date, credit toward another course, or a full refund.
5.2 Participant Cancellation:
- Participants may cancel their enrollment in writing at least 14 days prior to the course start date for a full refund.
- Cancellations made less than 14 days before the start date are non-refundable but may be eligible for a credit toward future courses at Digital Rugby’s discretion.
5.3 Non-Attendance:
- Failure to attend a scheduled session without prior notice does not entitle the Participant to a refund or rescheduling.
6. Intellectual Property
6.1 All training materials provided during the course are the intellectual property of Digital Rugby and are protected by copyright laws.
6.2 Participants are granted a non-transferable, non-exclusive license to use the materials for personal learning purposes only. Reproduction, distribution, or commercial use of the materials without written consent from Digital Rugby is prohibited.
7. Liability
7.1 Digital Rugby’s liability for any claims arising from the provision of training is limited to the course fees paid by the Participant.
7.2 Digital Rugby is not liable for:
- Loss of personal property during in-person sessions.
- Technical issues arising from the Participant’s equipment or internet connectivity during online sessions.
7.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence or fraud.
8. Data Protection
8.1 Digital Rugby will process Participant data in accordance with its Privacy Policy.
8.2 By enrolling, Participants consent to the use of their data for course administration and communication purposes.
9. Code of Conduct
9.1 Participants are expected to behave respectfully toward instructors and other participants.
9.2 Digital Rugby reserves the right to remove Participants from a course without refund for inappropriate behavior or failure to comply with these Terms.
10. Dispute Resolution
10.1 Any disputes arising from these Terms will first be resolved amicably through negotiation.
10.2 Unresolved disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales.
